Qloset
Intellectual Property Policy
How rights owners report suspected infringement, how Qloset reviews reports, and how affected Sellers may respond.
Effective August 31, 2026 · Version 1.0
Qloset respects intellectual property rights and works to maintain a trustworthy marketplace. This policy explains how rights owners and their authorized representatives may report suspected infringement involving content or products on Qloset, how Qloset reviews reports, and how affected Sellers may respond. For Sellers, this policy is incorporated into the Qloset Vendor Agreement, Version 1.0 as part of Qloset Seller Policy Set 1.0.
1. Scope
This policy applies to content and products made available through the Qloset mobile application and Qloset.dev, together called the “Platform.” The Platform is operated by HFX LLC (“Qloset,” “we,” “us,” or “our”).
Reports may concern copyrights, trademarks, patents, registered designs, trade dress, rights of publicity, or other recognized intellectual property rights. Different rights require different evidence. Submitting a report does not guarantee removal or other action.
Qloset’s actions under this policy are Platform-enforcement decisions based on information available to us. They do not constitute legal determinations regarding ownership, validity, authorization, infringement, or other disputed rights.
2. Who may submit a report
A report may be submitted by:
- The owner of the intellectual property right being reported.
- A representative authorized to act for the rights owner.
An authorized representative must identify the rights owner and provide evidence of authorization when requested.
3. How to report suspected infringement
Send reports to support@qloset.dev with the subject “Intellectual Property Report.”
Include:
- Your full name, organization, mailing address, phone number, and email address.
- The name of the rights owner, if different from the reporting party.
- Evidence that you own the reported right or are authorized to act for its owner.
- Identification of each right involved, including a registration or grant number when the right is registered.
- The jurisdiction and geographic scope of each claimed right.
- Direct URLs or other information that allows Qloset to locate each reported listing, image, description, product, storefront, or other material.
- A clear explanation of what allegedly infringes and where the infringement appears.
- Supporting documents, images, correspondence, authorization records, or order information that may help Qloset review the report.
- A statement that you have a good-faith belief that the reported use is not authorized by the rights owner, its representative, or another valid basis.
- A statement that the information in the report is accurate and that you are the rights owner or are authorized to act for the rights owner.
- Your physical or electronic signature.
Do not send passwords, payment-card information, bank information, or government identification unless Qloset specifically requests it through an appropriate channel.
Qloset may request additional information before reviewing or acting on a report. Reports that are incomplete, unsupported, misleading, or outside this policy may be rejected.
4. Evidence for different rights
Copyright
Identify the copyrighted work and provide the original work, a representative list, or a public link. Include the creator, current owner, creation or publication date, and registration number if registered. If ownership was transferred, include evidence showing the transfer or license.
Trademark and trade dress
Identify the mark, logo, or trade dress; the products or services connected to it; the claimed territory; and the alleged misuse. Provide the registration number if registered. For an unregistered claim, provide evidence of use, first-use dates, geographic scope, and customer recognition.
Patent or registered design
Provide the issued patent or design number, jurisdiction, current owner, and status. Identify the claims or protected design features involved and explain how each reported product allegedly infringes them.
Other rights
Identify the exact right, owner, applicable territory, basis for protection, and conduct alleged to infringe it.
5. What Qloset may do after receiving a report
Qloset may:
- Confirm whether the report contains enough information for review.
- Request additional information from the reporter or affected Seller.
- Restrict or remove reported content or products while reviewing the matter.
- Notify the affected Seller and provide information needed for a response.
- Maintain, restore, edit, restrict, or remove content based on information available to Qloset.
- Take action against an account under this policy and other Qloset policies.
Qloset reviews complete reports after receiving required information. Timing may vary based on report complexity, evidence, and responses from involved parties.
6. Seller responses
An affected Seller may request review by emailing support@qloset.dev with the subject “Response to Intellectual Property Report.”
The response should include:
- The Seller’s name, account email, and contact information.
- The affected listing or content URL.
- The reason the Seller believes the report is mistaken, incomplete, or unsupported.
- Evidence of ownership, license, or another valid basis for use.
- Relevant invoices, agreements, correspondence, or other supporting material.
- A statement that the response is accurate and submitted in good faith.
- The Seller’s physical or electronic signature.
Submitting a response does not automatically restore content or pause a protective action. Qloset may request more information, share relevant portions of the response with the reporter, restore the content, maintain the restriction, or take another Platform-enforcement action.
7. Information sharing
By submitting a report or response, you understand that Qloset may share relevant information and supporting materials with the affected reporter, rights owner, Seller, advisers, service providers, or authorities when needed to review the matter, protect the Platform, or respond to a valid request.
Qloset may redact government identification, payment or bank information, unnecessary residential addresses or personal phone numbers, and confidential commercial information. Do not include sensitive information that is not needed to explain or support the report or response.
8. Matters Qloset generally does not enforce as intellectual property infringement
Qloset generally does not enforce:
- Exclusive or selective distribution agreements.
- Minimum Advertised Price agreements.
- Authorized-reseller status by itself.
- Warranty coverage disputes without a separate intellectual property claim.
- Private contracts between manufacturers, distributors, retailers, or Sellers.
Qloset may review a report involving one of these matters when the reporter identifies a separate intellectual property right, applicable territory, and clear basis for the claim. Parallel-import and gray-market reports are reviewed based on the specific right, territory, product, and evidence presented. An authentic product is not automatically counterfeit because it was sold outside an authorized distribution channel.
9. False, misleading, or abusive reports
Do not knowingly submit false, fraudulent, incomplete, or misleading information. Qloset may reject reports submitted in bad faith, request verification, limit access to the reporting process, or take action against accounts that abuse this policy.
Reporters and responding Sellers remain responsible for statements and evidence they submit.
10. Enforcement and repeat infringement
Depending on the nature, severity, evidence, and history of the matter, Qloset may:
- Restrict, archive, or remove a listing or other content.
- Require proof of authenticity, authorization, ownership, or lawful sourcing.
- Limit a Seller’s ability to list products or accept new orders.
- Suspend or terminate Seller access.
- Act against attempts to evade a prior restriction or removal.
Repeated, knowing, severe, fraudulent, or evasive infringement may result in account termination. Qloset may act immediately when needed to protect rights owners, users, or the Platform.
11. Withdrawing a report
A reporter may ask to withdraw a report by emailing support@qloset.dev with the subject “Withdraw Intellectual Property Report.” Identify the reporter, original report, rights involved, and affected URLs.
Withdrawal does not guarantee restoration when Qloset has an independent concern, another report remains open, or the content violates another Qloset policy.
12. Changes and contact
Qloset may update this policy under the notice and acceptance process stated in the Vendor Agreement for Sellers. The policy version, Seller Policy Set, and effective date above identify the current text. For reporters and other Platform users, an updated policy applies from its stated effective date.
